Our Terms and Conditions

  1. These terms
    1. What these terms cover. These are the terms and conditions on which we supply goods to you. 
    2. Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. By placing an order with us,  through our website “www.borougholives.co.uk”, you agree to be bound by these terms and conditions.
  2. Information about us and how to contact us
    1. Who we are. We are Borough Olives Limited a company registered in England and Wales. Our company registration number is 05384366 and our registered office is at Unit 10 Driberg Way, Skitts Hill Industrial Estate, Braintree, Essex CM7 1ND. Our VAT registration number is 740847131. References to “we”, “us”, or “our” are references to Borough Olives Limited.
    2. How to contact us. You can contact us  by emailing us at info@borougholives.co.uk or by writing to us at Unit 10 Driberg Way, Skitts Hill Industrial Estate, Braintree, Essex CM7 1ND.
    3. How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order. 
    4. "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
  3. Our contract with you
    1. How we will accept your order. Our acceptance of your order will take place when we email you the dispatch confirmation, at which point a contract will come into existence between you and us. 
    2. If we cannot accept your order. If we are unable to accept your order, we will either not charge you or make a full refund if the payment has been made. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product. 
    3. We offer two ways to purchase our products. You can make a one off purchase through our online store (one off purchases) or you can enter into a subscription plan whereby we will send you products at regular agreed intervals (Regular Deliveries).
    4. We only sell to the UK. Our website is solely for the promotion of our products in the UK. There are some remote parts of the UK where we are unable to deliver to. Unfortunately, we do not accept orders from addresses outside the UK.
  4. Our products
    1. Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images. Although we have made every effort to be as accurate as possible, because our products are agricultural, all sizes, weights, capacities, dimensions and measurements indicated on our website have a 5% tolerance.
    2. Product packaging may vary. The packaging of the product may vary from that shown in images on our website. 
    3. Product changes. Our products are carefully sourced from small producers and we reserve the right to change our suppliers or products without notice.
    4. Food product care. We always take care and examine our products to make sure you receive excellent products. Some of our products are delivered in chilled bags and should be refrigerated immediately on receipt. 
    5. Stones. Whilst some of our products are pitted we cannot guarantee every one, so please be aware that some may contain stones or traces of stones.
  5. Your rights to make changes
    1. Subscription Plan (Olives By Post). If you wish to change or cancel your Subscription Plan you can do so by logging into your account on our website no later than 3 working days before your next delivery is due to be dispatched.
    2. One off purchases (Online Store). You can cancel your order any time before the products have been dispatched.
  6. DELIVERY
    1. Delivery costs for one off purchases. There is no charge for delivery for orders exceeding £35. For orders less than £35 there is a delivery charge of £4.90 (this includes VAT).
    2. Delivery costs for Subscription Plan. There is no charge for delivery on any of our Subscription Plan.
    3. When we will provide the products. For one off purchases, provided that we receive your order by 12pm, we aim to arrange delivery for the next working day, although this cannot be guaranteed (working days are Monday to Thursday excluding National Holidays). We will email you to confirm when your products have been dispatched. We will use a courier company to deliver your products and they will email or text you with an estimated delivery time (this cannot be guaranteed). 
    4. For the Subscription Plan (Olives By Post) we will do our best to arrange delivery on your preferred day although this cannot be guaranteed. We will email you to confirm when your products have been dispatched. For our Subscription Plan the products should fit through a standard size letter box and there is no need for anyone to be home for this service and no signature is required. 
    5. We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. We cannot be responsible for any delays caused by the Royal Mail or other courier companies. 
    6. If you are not at home when the product is delivered. Unless the goods fit through the letter box, by placing your order you are giving your consent to the delivery company to leave the products at your address or with a neighbour without a signature. We cannot be responsible for the products from this point onwards. Your parcel will not be redelivered or be available for collection.
    7. When you become responsible for the goods. A product which is goods will be your responsibility from the time we deliver the product to the address you gave us.
  7. Cancellation
    1. Subscription Plan (Olives By Post). You can cancel or change your subscription at any time provided that you give us at least 3 working days’ notice (working days are Monday to Thursday).
    2. One off purchases (Online Store). You can cancel your order at any timebefore the goods have been dispatched.
    3. To cancel a subscription, it is best to do it on our website once you log in or to cancel an order, please email us at info@borougholives.co.uk. It is your responsibility to ensure that any communication by you is not only transmitted by you, but received by us, before the deadlines stated in this clause above.
    4. We will make any refunds due to you as soon as possible. Any refunds will be made by the same method you used to place the order.
    5. Due to the perishable nature of the goods we deliver, you do not have a right to cancel the goods under the Consumer Contracts Regulations 2013.
  8. If there is a problem with the product
    1. How to tell us about problems. If you have any questions or complaints about the product, please contact us by emailing us at info@borougholives.co.uk or by writing to us at Unit 10 Driberg Way, Skitts Hill Industrial Estate, Braintree, Essex CM7 1ND. As we want you to be satisfied by our products, we will do our best to resolve the issue. We would request that you let us know within 3 days of receiving any faulty products.
    2. Summary of your legal rights. For detailed information please visit the Citizens Advice website www.adviceguide.org.uk or call 03454 04 05 06. 
    3. We are under a legal duty to supply products that are in conformity with this contract. Nothing in these terms will affect your legal rights.
    4. The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. 
    5. Refunds. Due to the perishable nature of the products, you are not entitled to a refund unless we are at fault. If you notify us within the use by or best before date of the products that the goods are faulty and we found this to be the case, you are entitled to a refund. 
    6. To return faulty goods. You should arrange for the goods to be returned to us by Royal Mail or a reputable courier. If the goods are found to be faulty we will contribute up to £5.00 toward the cost of having the goods delivered to us, upon submission of a receipt.
  9. Price and payment
    1. Where to find the price for the product. The price of the product (which includes VAT where applicable) will be the price indicated on the order pages when you place your order. We take all reasonable care to ensure that the price of the product advised to you is correct. However, we reserve the right to correct prices and change prices without prior notice.
    2. By subscribing to our Subscription Plan (Olives By Post) you are agreeing to pay recurring periodic charges at regular intervals in return for regular deliveries. When subscribing the frequency of your order and price will be clearly indicated on the order pages when you place your order. By entering into a Subscription Plan (Olives By Post) you acknowledge that your subscription has an initial charge followed by recurring periodic charges until you give us prior notice that you wish to change or cancel your Subscription Plan (Olives By Post).
    3. We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.
    4. What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. 
    5. When you must pay and how you must pay. You must pay for the products before we dispatch them. 
  10. Our responsibility for loss or damage suffered by you
    1. We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
    2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products; and for defective products under the Consumer Protection Act 1987
    3. We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  11. How we may use your personal information
    1. How we will use your personal information. We will use the personal information you provide to us:
      1. to supply the products to you;
      2. to process your payment for the products; and
      3. if you agreed to this during the order process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.

11.2 If you subscribe to our subscription service we will retain your card payment details and use them to pay for future purchases.

12. Our right to vary these terms

    1. We reserve the right to amend these terms and conditions from time to time.
    2. Every time you order products from us, the terms and conditions in place at the time you place your order will apply to the contract between you and us.                                                                        

 

 

13. Other important terms

    1. Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
